Introduction

These terms and conditions, which may be updated periodically, govern all our services provided either directly or through third-party distributors. Services may be accessed online, via mobile devices, email, or telephone. By accessing, browsing, or using our website or any of our applications on any platform and/or by making a reservation, you confirm that you have read, understood, and agree to the terms and conditions outlined here, including our Privacy Policy.

Age, Weight, & Health Restrictions

• Minimum age is six years and a minimum height of 1.2 metres (3.9 feet).
• Passengers exceeding 120 kg will be subject to an additional charge.
• Pregnant women, at any stage of pregnancy, are not permitted to fly.
• If you've recently undergone surgery or experience issues with your spine, neck, or mobility, please reach out for an assessment. The pilot will make the final decision on your suitability to fly.

Cancellation Policy

For cancellations initiated by you, the following refund structure applies:

• Full refund: More than 30 days before the flight.
• 50% Refund: Up to 14 days before the flight.
• 25% Refund: Up to four days before the flight.
• No Refund: No show or within 24 hours of the flight.

Waiver and Liability Release

1. Release of Liability

In consideration of Flying Odyssey and its affiliated advertisers and sponsors providing me with a pass for a hot air balloon flight, I, the undersigned, on behalf of myself and my heirs, executors, administrators, and assigns:

• Release Flying Odyssey, its advertisers, sponsors, and their directors, officers, agents, and employees from any and all claims, demands, damages, actions, or causes of action related to injury, loss of life, or property damage that may occur during my participation in the hot air balloon flight.
• Agree not to initiate claims or legal proceedings against any party seeking contribution or indemnity from Flying Odyssey, its advertisers, sponsors, or their respective directors, officers, agents, and employees.

2. Acknowledgement of Physical Condition

By signing below, I declare that :

• I am in suitable physical and medical condition to participate in the hot air balloon flight.
• I have not experienced any COVID-19 symptoms in the last fourteen (14) days.
• I acknowledge the inherent risks associated with participation, which could result in injury, property damage, or death.

Indemnity Agreement

In consideration of Flying Odyssey and its affiliated advertisers and sponsors providing me with a pass for a hot air balloon flight, I, the undersigned, agree to:

Indemnify and hold harmless Flying Odyssey, its advertisers, sponsors, and their respective directors, officers, agents, and employees against all losses, costs, and expenses, including legal fees, arising from my death, injury, or property damage incurred during the flight.
